1. General Terms and Conditions

By creating a Siptastic Account or using our Services, you accept these terms and conditions ("Conditions") under which Innova Communications Limited ("We", "Us", "Our" "Siptastic") will provide the Services to you ("You", "Your").

2. Definitions

• Account Details: Information provided by You when creating an account.
• Chargeback: Payment initially received by Us but subsequently rejected by You or Your card issuer.
• Communications Regulator: Government regulator for Phone Numbers and/or Voice Service provision.
• Consumer: An individual using our Services not as part of a business, trade, or profession.
• Contract: Agreement between You and Us formed by Your acceptance of the Conditions.
• Dashboard: Interface provided by Us to manage Your Services.
• Fees: Charges for Our Services.
• Phone Numbers: Includes Geographic and Non-Geographic Phone Numbers.
• Privacy Policy: Our policy on how we handle Your personal data.
• Services: Includes provision of Voice Services, management tools, support, and maintenance.

3. Provision of Services

We will provide the following Services to You in accordance with these Conditions:

• Provision of Voice Services.
• Management of Phone Numbers via the Dashboard.
• Telephone and e-mail support as specified on our website.
• Maintenance and upgrades of our software, hardware, and infrastructure at our discretion.

4. Your Obligations

You agree to:

• Notify Us immediately of any unauthorized use of the Services.
• Provide accurate and current information for account management.
• Use the Services lawfully and not for any prohibited purposes.
• Ensure passwords and identifiers are kept confidential and used properly.
• Accept liability for all actions and charges related to Your use of the Services.
• Pay on time as agreed when you opened the account.

5. Warranties

By using our Services, You warrant that:

• All provided information is correct and complete.
• You will maintain the confidentiality of passwords and identifiers.
• You have necessary permissions to use the Services without infringing third-party rights.

6. Indemnity

You will indemnify Us against all liabilities, costs, claims, and expenses arising from Your breach of the Contract or misuse of the Services.

7. Fees and Payment

• Fees are inclusive of VAT or other sales taxes.
• Payments must be made in full without deductions.
• We are not obligated to commence Services until required Fees are received.
• No refunds will be provided once Services are requested.

7.1 Recoverable Costs

If you fail to make payment by the due date, we reserve the right to apply a £12.50 administration fee to cover our costs associated with recovering the outstanding amount. This charge is not subject to VAT.

If payment remains outstanding beyond a reasonable period, we may take further steps to recover the debt, including but not limited to:

• Suspending or terminating the Services provided to you.
• Engaging a third-party debt collection agency to recover the amount due.

If we engage a debt collection agency, you agree that you will also be liable for any reasonable costs incurred by us in doing so, in addition to the outstanding amount and the administration fee. We reserve the right to pursue legal action to recover the full amount owed, including any applicable court costs and legal fees.

Failure to settle the debt may also result in a negative impact on your credit rating.

8. Liability

• We are not liable for any indirect or consequential losses.
• Our total liability is capped at 5000 Great British Pounds (Stirling).
• Nothing in this Contract excludes Our liability for death or personal injury caused by Our negligence.
• All call recordings stored on our phone services are stored for a maximum of 30 days then purged.
